Safeguarding freedom against preventive criminalization ("Vorverlagerung") is a recurrent theme in Criminal Law research. Nevertheless, the elements of "preventive criminalization" have rarely been discussed. The term remains undefined, its origins unrevealed. Additionally, claims to overcome the "dogma of causation" via preventive criminalization exemplify a connection to causation theory. Yet, the new developments in causation theory since the early 2000s have not been introduced into the discussion on preventive criminalization. Building on the results found researching these issues, this study develops the definition and limits of preventive criminalization.
