E-commerce, as a new form of commerciality, is at the root of the transformation of commercial relations and interactions between economic players. Although this digital revolution offers considerable opportunities in terms of accessibility, speed and globalization of exchanges, it also raises major challenges in terms of consumer protection.Indeed, consumers are often less informed and less competent than professionals, and this position is a source of vulnerability to online commercial practices, the risks of cyber-attacks and violations of their fundamental rights, such as informed consent, privacy and data security. Our study has highlighted the fundamental differences between e-commerce and traditional commerce, particularly in terms of the tools used, the actors involved, and the nature of the goods and services exchanged. These distinctions have important legal implications, particularly with regard to the formation of electronic contracts, the obligations of the parties, and protection mechanisms.
