Master's Thesis from the year 2025 in the subject African Studies - Culture and Applied Geography, grade: Good, , course: Business law, language: English, abstract: OHADA is a system of business law uniform across 17 west and central African countries. The ultimate goal of the Treaty was to provide its member states with a modern, western style set of business laws thus, making these states more attractive to foreign investors. This supranational organization currently has nine (9) statutes called Uniform Acts which focus exclusively on business matters ; the formation, the operation and dissolution of business entities and, the formation, performance and enforcement of business transactions. Thus it is aimed at accelerating the process of integration in the continent so as to enable it play its rightful role of global economy and addressing its multifaceted socio-economic and political problems. So, OHADA's main objective is to remedy legal and judicial insecurity that prevails in business law. In addition to the main objective, OHADA also has as goal to promote the system of arbitration as a speedy and discreet instrument of settlement of commercial disputes as well as improving the training of judges and auxiliary officer of justice. This can only be achieved with the establishment of a strong and independent court system in the national courts that can ensure the proper application of OHADA law and an efficient settlement of dispute in west and central Africa. It is therefore the duty of the judge to guaranty the interpretation of laws so as to ensure the direct and obligatory application of the Uniform Act in the various member states and their supranational position. Nevertheless, where there is a judge, there is a court registrar. This paper therefore seeks to situate the position and role of the registrar in the implementation of OHADA law which is not sufficiently highlighted by the legislator. To examine its competences during contentious and non-contentious matters, its recognition at the national and international level, its role in the execution of court decisions, the formation, the operation and dissolution of the business entities and during business transactions as far as OHADA law are concerned.

¿Dr. Achancho is a distinguished legal professional with over a decade of experience in Cameroon's judiciary. Holding a Ph.D. in Law, she has served as a legal officer and Senior Court Registrar across the Courts of First Instance and High Courts in the Fako Division. In addition to her judicial roles, Dr. Achancho contributes to legal education as a researcher and lecturer at the Catholic University of Central Africa.¿ In 2024, she was honored as a Mandela Washington Fellow, participating in the flagship program of the U.S. Government's Young African Leaders Initiative (YALI), which empowers young leaders through academic coursework, leadership training, and networking. ¿ Dr. Achancho actively advocates for women's rights in the legal sector. She founded the 'Get Away Corruption Initiative' to combat corruption and promote good governance within the judiciary. This initiative aims to establish Judicial Corruption Clubs in at least 10 courts in the South West Region, with a national target of 300 clubs.¿ Her efforts have been recognized with several accolades, including the Young Professional Fellowship in Canada, the International Volunteer Programme 2.0 in Istanbul, and the Mandela Washington Fellowship for Young African Leaders in the USA. Dr. Achancho also received an Honorary Alumnus Award from Bridgewater State University in the USA and was honored with the Obang Elites Academic Award in Cameroon. She has been personally congratulated by former U.S. President Barack Obama and Vice President Kamala Harris for her contributions.¿ Dedicated to empowering changemakers, youth, and marginalized communities, Dr. Achancho volunteers with Books2Africa UK. In her capacity as a legal officer, she has initiated workshops aimed at enhancing legal aid for vulnerable individuals, particularly in Cameroon's North West and South West regions. These initiatives have provided direct legal aid to over 80 vulnerable persons and strengthened the capacity of 100 stakeholders in protection measures and responses to gender-based violence. She also organizes seminars and workshops focused on skill development and strategic planning with stakeholders to improve access to justice for female inmates at the Buea Central Prison.¿ As a dedicated author, Dr. Achancho publishes books and articles, furthering her commitment to legal education and reform.
